Terms and Conditions
These Terms and Conditions ("Agreement") govern your use of the RATH software application (the "Service") operated by Kanaries Data ("us", "we", or "our").
By using the Service, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Service.
RATH is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). This license requires that the source code be made available to anyone who uses or modifies the software. By using or modifying RATH, you agree to abide by the terms of the AGPL-3.0 license.
Payment and Billing
Kanaries Data offers the Service on a subscription basis. Payment is due at the beginning of each subscription period. Subscription periods are one month, three months, six months, or one year. Prices for subscriptions are subject to change without notice.
If you cancel your subscription, you will not receive a refund for any remaining time in the subscription period.
The Service and its original content, features, and functionality are and will remain the exclusive property of Kanaries Data and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kanaries Data.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness.
By posting User Content to the Service, you grant Kanaries Data a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly display, publicly perform, reproduce, and distribute such User Content on and through the Service.
Disclaimer of Warranties
The Service is provided "AS IS" and without warranty of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Kanaries Data does not warrant that the Service will be uninterrupted, error-free, or completely secure.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Kanaries Data be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in any way connected with the use of or inability to use the Service, including but not limited to the use or inability to use any third-party software or services, whether based on contract, tort, negligence, strict liability or otherwise, even if Kanaries Data has been advised of the possibility of such damages.
This Agreement shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
These Terms and Conditions constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
